TBC Terms of Use
The agreement between you and TBC Media, LLC that governs your use of the TBC platform — our website, mobile apps, and APIs.
Thank you for using TBC! These Terms of Use (“Terms”) apply to your use of the TBC platform, including our website, mobile applications, APIs, and all associated services (collectively, the “Services”). These Terms form an agreement between you and TBC Media, LLC. By using our Services, you agree to these Terms.
Our Privacy Policy explains how we collect and use personal information, and our Content Policy sets out what you may and may not publish on TBC.
Important: these Terms include a binding arbitration agreement and class-action waiver. You may opt out within 30 days of first agreeing to these Terms.
1. Plain-English summary
- Who can use TBC: 13 and up (or higher where required by your country); under 18 needs a parent or guardian's permission.
- Your videos stay yours. You grant us a license to host, transcode, analyze, and show them through the Services. Delete a Cliff and the license ends, except for backups and copies others have already received.
- Don't be a jerk. No harassment, fraud, scraping, fake engagement, IP infringement, or building a competitor on our platform.
- We moderate. Uploaded videos are scanned automatically for explicit content, and our team reviews flagged Cliffs. We may remove content or suspend accounts that break the rules; you can appeal.
- Paid features are not yet available on TBC. If we add them, they will be governed by §9 below.
- Disputes go to arbitration (no class actions) unless you opt out within 30 days.
2. About TBC
TBC is a collaborative video-storytelling platform. Creators publish short videos called Cliffs; viewers can continue a story by uploading their own Cliff that branches from someone else's. Cliffs are organized into StoryWorlds, which can be public or private, and we measure each Cliff's narrative impact through a metric we call the Serial Momentum Index (SMI).
3. Who may use our Services
Minimum age
You must be at least 13 years old, or the minimum age required in your country to consent to use the Services. If you are under 18, you must have your parent or legal guardian's permission to use the Services.
Registration
To create an account you must provide a valid email address, choose a username, and choose a password. We use Google Firebase Authentication to handle credential storage. You may not share your account credentials, and you are responsible for all activity that occurs under your account. If you create an account on behalf of another person or entity, you must have authority to accept these Terms on their behalf.
4. Using TBC
What you can do
Subject to your compliance with these Terms, you may:
- Set up a profile with a display name, biography, and profile photo.
- Record or upload videos as Cliffs.
- Continue another creator's Cliff by publishing a branching Cliff of your own.
- React to Cliffs (like, favorite, dislike) and favorite other creators (on TBC, favoriting a user is the same as following them).
- Comment on Cliffs (when this feature is launched).
- Create or join StoryWorlds, including private StoryWorlds with controlled access through groups.
- Search and browse the StoryBoard graph.
You must comply with all applicable laws and with our Content Policy and any other guidelines we publish.
What you cannot do
You may not use the Services to do, or attempt to do, any of the following:
- Infringe, misappropriate, or violate anyone else's intellectual property, privacy, publicity, or other rights.
- Modify, copy, lease, sell, or distribute any part of the Services.
- Reverse engineer, decompile, or attempt to extract source code, model weights, embeddings, or other underlying components of the Services.
- Scrape, crawl, harvest, or programmatically extract content or output from the Services, including by abusing our APIs or signed media URLs.
- Misrepresent AI-generated content as human-created in a way that misleads other users.
- Interfere with or disrupt the Services, including by introducing viruses, malware, or other harmful code, or by overwhelming our infrastructure.
- Use the Services to develop a competing video, social, or storytelling platform.
- Buy, sell, or transfer accounts, follows, reactions, SMI scores, or other platform metrics.
- Create fake accounts or use automated systems to inflate engagement.
- Impersonate others or misrepresent your affiliation with any person or entity.
- Harass, abuse, threaten, or incite violence against any individual or group.
- Post content that violates our Content Policy.
5. Content and intellectual property
Your Content
You may upload videos, profile information (display name, biography, profile photo), comments, and other materials to the Services (collectively, “Your Content”). You retain ownership of Your Content. By posting Your Content on TBC you grant us the licenses described below.
You represent and warrant that:
- You own or have all necessary rights, licenses, and permissions to upload and share Your Content (including any music, footage, voices, or likenesses appearing in it).
- Your Content does not infringe, misappropriate, or violate any third party's intellectual-property, privacy, publicity, or other rights.
- Your Content complies with all applicable laws and our Content Policy.
License to Your Content
By uploading Your Content, you grant TBC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, copy, transcode, segment, encode, analyze, generate thumbnails and embeddings from, modify (e.g., format conversion), publicly perform, publicly display, communicate, and distribute Your Content. This license is for the purpose of operating, providing, securing, and improving the Services. The license ends when you delete the Cliff, except that we may retain the Cliff in encrypted backups for a limited period (no longer than 90 days), and other users may retain copies they have already received.
Because TBC is collaborative, your published Cliffs are intended as permanent contributions to the StoryBoard. If you delete your account, the license you grant in this section survives with respect to Cliffs you have already published: TBC retains those Cliffs as anonymous contributions, attributed to a generic [deleted] label, so the stories other creators have continued from your work are not broken. The license terminates with respect to any individual Cliff you delete yourself while your account is active. After account deletion, you may still request removal of individual published Cliffs by emailing privacy@2bc.app; we will review such requests under applicable law as described in our Privacy Policy.
Continuations and derivative works
TBC's core feature is letting other creators continue your Cliff with a branching Cliff of their own. By publishing a Cliff to a public StoryWorld, you authorize other users to continue it through the in-app continuation control. The continuation is a separate work owned by its creator; it does not transfer ownership of your original Cliff.
Other users' rights
When you publish a Cliff to a public StoryWorld, you grant other users the right to view, react to, and continue it within the Services in accordance with the features we make available.
TBC's content
The Services include content owned or licensed by TBC, including text, graphics, logos, icons, images, software, model weights, and other materials (“TBC Content”). TBC Content is protected by copyright, trademark, and other laws. You may not use, copy, reproduce, distribute, or create derivative works based on TBC Content without our express written permission.
Feedback
If you send us suggestions, feedback, or ideas about the Services, you agree that we may use them without restriction or compensation to you.
6. Automated content analysis
You acknowledge and agree that, when you upload a Cliff, TBC's automated pipeline will process the video on our infrastructure to:
- Screen for explicit content using NSFW-detection models;
- Generate transcripts of spoken audio;
- Generate scene summaries and search-index entries;
- Detect on-screen characters and generate face-recognition embeddings to support story continuity within your StoryWorlds.
These artifacts are stored alongside your Cliff and are deleted when the Cliff is deleted. TBC does not send your Cliff to a third-party AI vendor for these tasks. See the Privacy Policy for more detail.
7. Third-party services and links
Our Services rely on third-party infrastructure providers (for authentication, cloud hosting, object storage, content delivery, and transactional email) to operate. The current list of vendors and the categories of information each one processes is described in our Privacy Policy. The Services may also link to third-party websites, applications, or content. Third-party services and sites are governed by their own terms and privacy policies; we are not responsible for them, and your use of them is at your own risk.
8. Content moderation and enforcement
How we moderate
We use a combination of automated systems (including the NSFW screening described in §6) and human review to detect and address content that may violate these Terms or our Content Policy. We do not pre-screen all content before it appears on the Services.
Enforcement actions
When we become aware of a violation, we may:
- Remove or restrict access to the offending content;
- Limit or disable account features;
- Suspend or terminate accounts;
- Report illegal activity to law enforcement.
Reporting and blocking
We are building in-app controls to report Cliffs and abusive users and to block users from interacting with you. Until those controls are live, you may report content or users by emailing support@2bc.app with a link to the Cliff or a screenshot. We aim to review reports within 24 hours and remove content that violates these Terms or our Content Policy. Users responsible for serious or repeated abuse may be permanently removed from the platform.
Appeals
If we take an enforcement action on your account or content, you may appeal by emailing support@2bc.app within 30 days of the action. We will review your appeal and respond within a reasonable timeframe.
9. Paid features and subscriptions
TBC currently offers a single free subscription tier. The Services do not yet support paid subscriptions, in-app purchases, or virtual items. The terms in this section will take effect at the time we make any paid feature available, and we will give you advance notice before that happens.
- Premium Services. If we offer paid features, subscriptions, or other premium services (“Premium Services”), you will agree to pay all applicable fees and taxes at the time of purchase. All fees are non-refundable except as required by law.
- Subscriptions and auto-renewal. Subscriptions, if offered, will automatically renew at the end of each billing period unless cancelled before the renewal date.
- How to cancel. iOS subscriptions are managed through
Settings → [Your name] → Subscriptionson your Apple device or via the App Store; Android subscriptions are managed through the Google Play Store underPayments & subscriptions → Subscriptions; web subscriptions are managed through your account settings or by emailing support@2bc.app. - Free trials. Where we offer a free trial, you must cancel before the end of the trial to avoid being charged. Trial eligibility may be limited.
- Pricing changes. We may change pricing on reasonable notice, with the change taking effect at your next billing cycle.
- Virtual items. Any virtual items, tokens, or in-app currency we may offer are licensed (not sold) to you, have no monetary value, are non-transferable, and may be revoked or expire on account termination.
10. App store terms (Apple & Google)
If you downloaded the TBC mobile app from Apple's App Store or Google Play, additional terms apply because of those platforms' developer agreements.
Apple App Store
This subsection applies if you obtained the TBC iOS app from the Apple App Store:
- These Terms are between you and TBC only — not Apple — and Apple is not responsible for the app or its content.
- The app is licensed (not sold) to you for use only on Apple-branded products that you own or control, and as permitted by the Apple Media Services Terms. Where these Terms are less restrictive than that EULA, our Terms govern.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are TBC's responsibility, not Apple's.
- TBC, not Apple, is responsible for addressing any product-liability claims, claims that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
- TBC, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property claim that the app or your possession and use of it infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.
Google Play
This subsection applies if you obtained the TBC Android app from Google Play:
- You acknowledge that the Google Play Terms of Service also apply to your use of the app.
- These Terms are between you and TBC only, not Google. Google is not responsible for the app or its content.
- To the extent these Terms conflict with the Google Play Terms with respect to your use of the app obtained through Google Play, the Google Play Terms control solely with respect to that conflict.
- Google has no obligation to provide support or maintenance for the app.
11. DMCA / copyright notices
TBC respects the intellectual property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws in other jurisdictions.
Submitting a notice
To submit a DMCA notice, send the following to our designated agent:
- A physical or electronic signature of the copyright owner or authorized representative;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material claimed to be infringing, with enough detail (such as the Cliff URL) for us to locate it;
- Your contact information, including address, telephone number, and email;
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Designated DMCA agent: legal@2bc.app (or by mail to TBC Media, LLC, Attn: DMCA Agent, 4700 Belleview Avenue, Suite 300, Kansas City, MO 64112).
Counter-notices and repeat infringers
If your Cliff was removed and you believe in good faith that it was a mistake or misidentification, you may submit a counter-notice. We terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.
12. Termination and suspension
By you
You may stop using our Services at any time. To delete your account, email privacy@2bc.app from the address associated with your account. We will complete the deletion within 30 days. We are also building an in-app deletion control reachable from Profile → Settings → Delete account; it will be available before public app-store launch.
By us
We may suspend or terminate your access to our Services at any time if:
- You violate these Terms or our policies;
- We are required to do so by law;
- Your use of the Services creates risk or legal exposure for us or other users;
- We decide to discontinue the Services or particular features.
We will provide reasonable notice before terminating your account, except in cases involving illegal activity, severe violations, or circumstances where providing notice would create legal liability for us. You may appeal as described in §8.
13. Disclaimers and limitations of liability
Service “as is”
Limitation of liability
Indemnification
You agree to indemnify, defend, and hold harmless the TBC Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of another.
14. Dispute resolution and arbitration
Please read this section carefully. It requires you to arbitrate disputes with TBC and limits the way you can seek relief. You can opt out within 30 days of first agreeing to these Terms.
Informal resolution
If you have a dispute with us, please contact legal@2bc.app first; most disputes can be resolved informally.
Binding arbitration
If we cannot resolve a dispute informally, you and TBC agree to resolve any claim arising out of or related to these Terms or the Services through final and binding arbitration, conducted by a single arbitrator under the rules of the American Arbitration Association (AAA). The arbitration will take place in Kansas City, Missouri or another mutually agreeable location.
Exceptions
Either party may bring a qualifying claim in small claims court, and either party may seek equitable relief in court to protect intellectual property rights.
No class actions
Disputes will be resolved individually and not as a class action, class arbitration, or any other representative proceeding. You and TBC waive any right to participate in a class action or class-wide arbitration.
Opt-out
You may opt out of this arbitration agreement by sending written notice to legal@2bc.app within 30 days of first agreeing to these Terms, including your name, email address, and a statement that you wish to opt out of arbitration.
15. General terms
Modifications to Terms
We may modify these Terms from time to time. If we make material changes, we will notify you by email, through the Services, or by other means, and give you an opportunity to review the changes before they take effect.
Modifications to Services
We may add, change, or remove features or functionality, and we may suspend or discontinue the Services. We will provide reasonable notice of significant changes or discontinuations where feasible.
Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws provisions.
Entire agreement
These Terms, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and TBC regarding the Services.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid or unenforceable provision will be modified to achieve the parties' intent as closely as possible.
No waiver
Our failure to enforce any provision is not a waiver of that provision or any other.
Assignment
You may not assign these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
